Will the NRC and CAA be repealed in the same way as farm laws were in 2021?

The decision to repeal the farm regulations was widely applauded by many sections of society, including the Opposition and farmers. However, many others were outraged by the move, claiming that the government had backtracked on improvements.

Following the announcement by Prime Minister Narendra Modi, the Centre has decided to repeal three controversial pieces of agricultural legislation that were enacted previously. The CAA should be rejected, he urged the Centre, saying: “Our Prime Minister claims that our country’s structure is democratic; as a result, he should pay close attention to the laws that have been introduced involving Muslims.” The CAA should be repealed in the same way that the agri-laws were.”

What exactly is CAA?

Several provisions of the Citizenship Act of 1955 govern the acquisition, determination, and termination of Indian citizenship. There have been various amendments to the Act in the past; the most recent change was ratified by Parliament on December 11, 2018.

The Citizenship (Amendment) Act, 2019 (CAA) offers the right to apply for Indian citizenship to migrants/foreigners belonging to six minority communities from three specified countries who have fled religious persecution in their home countries.

The CAA is a piece of legislation that amends the Citizenship (Amendment) Act, 1955 (CA). After meeting the bare minimum of legal requirements, a foreign national will be eligible to petition for citizenship in the United States.

What exactly is the NRC?

The National Register of Citizens (NCR) is a database that contains information about Indian citizens. The Citizenship Act of 1995 mandates the mandatory registration of all citizens of India, as well as the issue of a National Identity Card to each of them.

Known as the Citizenship Amendment Act (CAA), it is one of the most discriminating pieces of legislation passed by independent India, as it substantially alters the fundamental terms and conditions of Indian citizenship. According to the Indian Constitution, the legislation contradicts several important sections.

For example, article 14, which stipulates unequivocally that the state shall not deny any person equality before the law, as well as article 21, which ensures one’s right to life and liberty, are both violated.

Those of Muslim religion, who constitute the majority of India’s religious minorities and number around 200 million people, are not only formally excluded, but also marginalized by the CAA.

It is unclear how a landless Dalit from Bihar, a Muslim migrant laborer from Bengal, or an Adivasi woman from Andhra Pradesh will be able to verify their citizenship.
